Hijab row: The Supreme Court notifies the Karnataka government of a petition challenging an HC order

On Monday, the Supreme Court gave the Karnataka government notice in response to a petition challenging the High Court’s decision upholding the state’s ban on the hijab in public schools.

Some appellants requested an adjournment, but a bench of Justices Hemant Gupta and Sudhanshu Dhulia rejected their request, stating that it would permit “forum shopping.” On September 5, the next hearing in the case was scheduled.

The Karnataka High Court’s ruling that wearing the hijab is not a part of the fundamental religious practise that can be protected under Article 25 of the Constitution has been challenged in a number of petitions filed with the Supreme Court.

In order to be allowed to wear hijabs in class, Muslim girls enrolled in pre-university colleges in Udupi filed a number of petitions with the High Court.
